Terms of Service

These terms set out the agreement between you and Champion Spirit when you use our application, our websites, or the services provided at the club in Nassau. Please read them, and read our Privacy Policy Terms of Service alongside them.

1. Acceptance of these terms

These terms govern your use of the Champion Spirit application, our websites, and the services provided at the Champion Spirit Country Club in Nassau, The Bahamas. By creating an account, booking a service, or entering the estate, you accept them.

If you do not accept these terms, do not use the application or the services.

2. Your account

You must be eighteen or older to create an account. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for everything done under your account.

Tell us immediately if you believe your account has been used without your permission. We may suspend an account where we reasonably suspect fraud, abuse, or a breach of these terms.

3. The services

The application gives access to bookings, day passes, membership information, programme details, and, where you choose to connect a source, a view of your own health and fitness data.

Availability of any given service, class, practitioner or facility is not guaranteed. We may change, suspend or withdraw parts of the service for maintenance, safety, or operational reasons.

4. Bookings, passes and membership

Bookings and day passes are confirmed once payment is received. Membership is granted by application and is subject to acceptance after interview. Membership confers no ownership interest in the club or the estate.

Rates, inclusions and current conditions are published on our membership site and prevail over any other version.

5. Payment

Payments are processed by our payment provider. We do not store full card numbers. Unless stated otherwise, rates are exclusive of value added tax, which is added at the applicable rate.

Where a subscription or annual due applies, it renews according to the terms accepted at purchase.

6. Cancellation and refunds

Cancellation conditions depend on the service booked and are presented at the time of booking. Where a cancellation window is stated, cancellations inside that window may not be refundable.

If we cancel a service for a reason within our control, we offer a reschedule or a refund of the amount paid for that service.

7. Conduct on the estate

The estate is a private club. Members, guests and visitors are expected to follow the house rules, the instructions of staff, and the safety requirements of each facility.

We may refuse or withdraw access, without refund, in case of conduct that endangers others, damages property, or disregards the standards of the club.

8. Health, fitness and medical disclaimer

Training, recovery and assessment services carry inherent physical risk. You confirm that you are fit to take part, and you agree to disclose any condition that could affect your safety or the safety of others.

Information displayed in the application, including data from connected devices, is provided for information only. It is not a medical diagnosis and it does not replace the advice of a qualified physician. Consult a doctor before beginning or changing any programme, and seek medical attention if you feel unwell.

9. Your data

How we collect, use and protect personal data, including health and fitness data, is described in our Privacy Policy, which forms part of these terms.

10. Intellectual property

The Champion Spirit name, logo, written content, photography, video, programme names and method are owned by Champion Spirit or its licensors. You may use them only as needed to use the services.

You may not copy, resell, reproduce or exploit any part of the services or their content without our written permission.

11. Content you submit

You remain the owner of the content you submit. By submitting it, you grant us a licence to host, store and display it to the extent required to operate the service.

Do not submit content that is unlawful, offensive, or that infringes the rights of others. We may remove such content.

12. Liability

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be excluded.

Subject to that, we are not liable for indirect or consequential loss, for loss of profit, or for the unavailability of a facility or service. Our total liability in connection with a service is limited to the amount you paid for that service.

13. Suspension and termination

You may close your account at any time, as described in section 9 of the Privacy Policy. We may suspend or terminate access where these terms are breached, where payment fails, or where required by law.

Termination does not affect rights and obligations already accrued, including payment due.

14. Changes to these terms

We update these terms when our services or our obligations change. The date at the top of the page reflects the current version. Where a change is significant, we inform you in the application or by email before it takes effect.

15. Governing law

These terms are governed by the laws of The Commonwealth of The Bahamas, and the courts of The Bahamas have jurisdiction, without prejudice to any mandatory protection available to you under the law of your country of residence.
